Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Mealody mobile application ("the App").

1. Operator

Mealody is operated by an individual developer ("Operator," "we," "our," or "us").

2. Acceptance of Terms

By downloading, installing, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the App.

3. Age Requirements

You must be at least 13 years old to use the App (or the minimum age required in your country, if higher).

If you are under 18, you confirm that you have obtained parental or guardian consent to use the App and that your parent or guardian has read and agrees to these Terms on your behalf.

4. Description of Service

Mealody is a mobile application that helps you decide what to cook. Based on the ingredients in your fridge, your dietary preferences, allergies, and the people you cook for, the App can:

• Suggest and rank recipes from its recipe catalog
• Track the contents of your fridge, including items added by photo
• Build a weekly meal plan and a grocery list from it
• Store profiles for members of your household so meals suit everyone
• Provide optional AI features: a cooking chat assistant, adapting a recipe to what you have, and creating new dish ideas in Studio (see section 13)
• Send local push notifications with meal suggestions at your preferred meal times

Some features are free and some require a paid subscription (see section 14). Features may be added, changed, or removed over time.

5. Nature of the Service

Mealody is an informational meal suggestion tool. It is intended for general informational and entertainment purposes only.

Mealody is NOT:

• A medical service or healthcare provider
• A licensed dietitian, nutritionist, or allergist
• An allergy-detection or allergy-prevention system
• A food safety authority or food testing service
• A substitute for professional medical, dietary, or nutritional advice

All recipes, nutritional information, and meal suggestions are generated from a recipe database or by artificial intelligence, and may be inaccurate, incomplete, outdated, or incorrect. They are not reviewed or verified by qualified health professionals.

6. No Medical or Nutritional Advice

THE RECIPES, NUTRITIONAL INFORMATION, CALORIE COUNTS, MACRO BREAKDOWNS, AND MEAL SUGGESTIONS PROVIDED BY MEALODY ARE FOR INFORMATIONAL AND ENTERTAINMENT PURPOSES ONLY. THEY DO NOT CONSTITUTE MEDICAL, NUTRITIONAL, OR DIETARY ADVICE.

Mealody is NOT A SUBSTITUTE for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider, allergist, or registered dietitian before making changes to your diet, especially if you have food allergies, intolerances, medical conditions, or specific nutritional needs.

7. Allergy & Health Risk Acknowledgment

By using Mealody, you expressly acknowledge and agree to ALL of the following:

• The App's allergen information is derived from a recipe database and may be INCOMPLETE, INACCURATE, OR OUTDATED. Ingredients in recipes can vary by brand, region, preparation method, and supplier.
• The App DOES NOT account for cross-contamination, manufacturing changes, regional ingredient variations, or unlisted sub-ingredients that may be present in food products.
• Allergy and dietary preference data is SELF-REPORTED BY YOU and is not verified by any medical professional. Errors, omissions, or outdated information in your profile settings may result in unsuitable recipe recommendations.
• YOU ARE SOLELY RESPONSIBLE for verifying the ingredients, allergen content, and nutritional information of any recipe before preparing or consuming it. You should ALWAYS read actual food labels and verify ingredients independently.
• Some recipes, ingredient lists, and dish ideas in the App are GENERATED BY ARTIFICIAL INTELLIGENCE and are not reviewed by a human before you see them. AI can make mistakes, invent ingredients, or misjudge what is safe. The App re-checks AI suggestions against your saved allergies and diet, but this check is not guaranteed to catch everything. You must still read every ingredient yourself before cooking or eating.
• Food items detected from a photo of your fridge may be wrong, missed, or misidentified. Always confirm what you actually have.
• Mealody is NOT DESIGNED OR INTENDED to prevent allergic reactions or ensure food safety.
• Mealody is NOT LIABLE for any allergic reactions, adverse health effects, illness, injury, hospitalization, or death resulting from your use of or reliance on recipes, meal suggestions, nutritional information, or allergen data provided by the App.

8. Food Safety Disclaimer

Mealody does not verify, guarantee, or take responsibility for:

• Cooking temperatures or cooking times
• Food storage safety or shelf life accuracy
• Expiration or best-before dates
• Cross-contamination risks during food preparation
• Preparation hygiene or kitchen safety
• Serving sizes or portion accuracy

You assume full responsibility for safe food handling, preparation, storage, and consumption. If you are unsure about food safety, consult a qualified food safety professional.

9. Assumption of Risk

You voluntarily assume all risks associated with:

• Preparing and consuming meals based on recipes or suggestions provided by the App
• Following any instructions, ingredient lists, or nutritional information provided by the App
• Any adverse reactions, including allergic reactions, foodborne illness, nutritional imbalances, or other health effects

You understand that food preparation involves inherent risks and agree that Mealody shall not be held responsible for any such outcomes. Use of the App is entirely at your own risk.

10. Emergency Situations

Mealody does not provide emergency services. If you experience a severe allergic reaction (anaphylaxis), food poisoning, or any medical emergency, contact your local emergency services immediately. Do not rely on the App in any emergency situation.

11. User Accounts

11.1 Account Security

You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access.

11.2 Acceptable Use

You agree to:

• Provide accurate information during registration and onboarding
• Use the App for personal, non-commercial purposes only
• Keep your allergy and dietary information accurate and up to date
• Not attempt to reverse-engineer, decompile, or disassemble the App
• Not use the App for any unlawful purpose
• Not create multiple accounts or share account credentials
• Not upload unlawful, harmful, infringing, or abusive content

12. User Content

You may input content into the App, including but not limited to fridge ingredient lists, dietary preferences, meal preferences, photos of your food or fridge, messages you send to the AI assistant, and household member profiles ("User Content"). You retain ownership of your User Content. By using the App, you grant us a limited, non-exclusive license to use your User Content solely for the purpose of providing the service to you, including sending it to our service providers where required to run a feature you requested (see our Privacy Policy).

By submitting User Content, you confirm that:

• You have the right to submit it, and any photo you upload is yours to share.
• Photos you upload are of food, ingredients, or your kitchen, not of other people, and not unlawful, harmful, or offensive material.
• If you add a household member's details, you have their permission, and if that person is a child, you are their parent or legal guardian.

13. AI Features

Mealody includes optional AI-powered features: the Ask Mealody chat assistant, Photo → Fridge item detection, recipe adaptation, and Studio dish creation. These features are powered by a third-party AI provider (currently the Google Gemini API), and are described in our Privacy Policy.

13.1 Consent & Optionality

AI features are off until you consent to them in the App. You may decline and continue using the rest of Mealody normally.

13.2 AI Output Is Not Reliable

IMPORTANT: AI-generated recipes, ingredients, cooking steps, nutrition figures, images, and chat replies may be inaccurate, invented, or unsafe. They are produced automatically and are not reviewed by a human, a dietitian, or a medical professional before you see them. The allergy, food safety, and liability terms in sections 5 to 10 apply to AI output in full. Always verify ingredients and cooking instructions yourself before cooking or eating.

13.3 Acceptable Use of AI

You agree not to:

• Use the AI features for anything other than food, cooking, and meal planning
• Upload photos of people, or any unlawful, harmful, or offensive content
• Attempt to bypass the App's safety filters, allergy checks, or usage limits
• Use the AI features to generate content that is illegal, harmful, or infringes anyone's rights
• Resell, scrape, or commercially exploit AI output or the recipe catalog

We may suspend access to AI features if they are misused, or if usage is abnormal or abusive.

13.4 Ownership of AI Output

You may use the dishes and content you generate in the App for your own personal, non-commercial cooking. AI output is generated automatically and may not be unique to you. Similar or identical content may be generated for other users. We do not claim that AI output is original or that you hold exclusive rights in it.

13.5 Availability & Limits

AI features depend on a third-party provider and may be slow, unavailable, changed, limited, or discontinued at any time. Usage limits apply per subscription tier and may be adjusted to keep the service sustainable and prevent abuse (see section 14.2).

14. Subscriptions & Payments

14.1 Plans

Mealody is free to use with a limited set of features. Paid plans (currently Pro and Pro+) unlock additional features and higher AI usage limits, and are sold as auto-renewing subscriptions through Apple In-App Purchase. The plans, their billing periods, and the exact prices in your local currency are shown in the App at the time of purchase.

14.2 AI Usage Limits & Fair Use

AI features (chat, photo scanning, recipe adaptation, plan generation, and Studio dish creation) are subject to usage limits that depend on your plan. The limits that apply to you are shown in the App.

Where a plan is described as offering unlimited use of a feature, this is subject to fair use: because each AI request has a real cost, we may apply reasonable safeguards against excessive, automated, or abusive use. We may adjust limits over time to keep the service sustainable. If a change would materially reduce what you paid for, you may cancel your subscription through Apple.

14.3 Billing, Renewal & Free Trials

• Payment is charged to your Apple ID at confirmation of purchase.
• Subscriptions auto-renew unless canceled at least 24 hours before the end of the current billing period. Your Apple ID is charged for renewal within 24 hours before the current period ends.
• If a free trial is offered, any unused portion is forfeited when you purchase a subscription, and the trial automatically converts to a paid subscription unless you cancel at least 24 hours before it ends.
• Payment and billing are handled entirely by Apple. We do not collect or store payment information.
• Pricing may change. Existing subscribers will be notified before any price increase takes effect, in the manner Apple requires.

14.4 Cancellation & Refunds

• You can cancel at any time in Settings > [your name] > Subscriptions on your Apple device. Cancellation takes effect at the end of the current billing period, and you keep access until then.
• Deleting the App does not cancel your subscription.
• Refunds are handled by Apple, not by us. We cannot grant or deny a refund. Requests are made at reportaproblem.apple.com and are subject to Apple's refund policies.

15. Apple-Specific Terms

These Terms are between you and us only, not with Apple. Apple is not responsible for the App or its content. You further acknowledge and agree that:

• Apple has no obligation to provide maintenance or support for the App.
• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
• We, not Apple, are responsible for addressing any claims relating to the App, including product liability claims, any claim that the App fails to conform to a legal or regulatory requirement, and claims under consumer protection or similar legislation.
• We, not Apple, are responsible for investigating and defending any third-party claim that the App infringes intellectual property rights.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce them against you.

16. Intellectual Property

All content in the App (including but not limited to recipes, images, text, graphics, icons, logos, animations, and software code) is the property of Mealody or its content suppliers and is protected by applicable intellectual property laws.

You may not copy, reproduce, modify, distribute, publicly display, or create derivative works based on this content without our prior written consent. This does not restrict your own User Content (section 12) or the dishes you generate for personal use (section 13.4), and it does not prevent you from sharing a recipe or meal plan using the sharing features built into the App.

17. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We make no guarantee regarding:

• The accuracy, reliability, or completeness of any recipe, allergen data, nutritional information, or meal suggestion
• The availability, continuity, or error-free operation of the App
• The safety or suitability of any recipe for your individual health needs
• The App being free of viruses or other harmful components
• Fitness for a particular purpose or non-infringement

18. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:

• We are not liable for any allergic reactions, illness, injury, hospitalization, adverse health effects, or death resulting from your use of the App, including any reliance on recipes, meal suggestions, allergen data, or nutritional information.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, loss of profits, or personal injury.
• Our total aggregate liability to you for any and all claims arising from your use of the App shall not exceed the total amount you have paid to us in the twelve (12) months preceding the claim.
• If you have paid nothing, our total liability is zero.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability is limited to the minimum extent permitted by applicable law. Nothing in these Terms excludes or limits liability that cannot be lawfully excluded.

19. Indemnification

You agree to indemnify, defend, and hold harmless Mealody, the Operator, and their affiliates from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from:

• Your use of the App
• Your reliance on any recipe, nutritional information, or meal suggestion provided by the App
• Your violation of these Terms
• Any allergic reaction, illness, or injury resulting from food you prepared based on App content
• Your violation of any applicable law or regulation

20. Account Termination

You may delete your account at any time from within the App (Settings > Delete Account). Upon deletion, your personal data will be permanently removed as described in our Privacy Policy.

We reserve the right to suspend or terminate your account at any time if:

• You violate these Terms of Service
• You engage in fraudulent, abusive, or harmful behavior
• Your account poses a security risk to the App or other users
• Required by applicable law

21. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

22. International Users

Mealody is available to users worldwide. If you access the App from outside the country where the Operator is located, you do so at your own initiative and are responsible for compliance with applicable local laws. Recipes and nutritional data may reflect ingredients, measurements, or food standards that differ from those in your country.

Mandatory consumer protection rights in your jurisdiction remain unaffected by these Terms.

23. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Operator resides, without regard to conflict of law principles.

Any disputes arising out of or relating to these Terms or your use of the App shall first be attempted to be resolved through informal negotiation by contacting us at the email below.

If the dispute cannot be resolved within thirty (30) days, either party may pursue resolution through the competent courts in the Operator's jurisdiction, unless mandatory consumer protection laws in your jurisdiction require otherwise.

24. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its intent.

25. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Mealody regarding your use of the App and supersede any prior agreements or understandings.

26. Changes to These Terms

We may update these Terms from time to time. Changes will be indicated by updating the "Last Updated" date at the top of this page.

For material changes, we will make reasonable efforts to notify you. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms. If you do not agree with the updated Terms, you must stop using the App and delete your account.
